Hampshire County, WV - Marriage License Requirements
**The Party that’s applying for a WV Marriage License is responsible for finding a WV Licensed Officiant to perform your marriage.

Age requirement:
- You must be 18 years old or older to marry without parental consent.
- If either party is under the age of 18, parental or guardian consent forms must be signed by the parent/guardian with full/joint custody. Custody papers are required.
- You can get a consent form from the Hampshire County Clerk’s office.
- Age 15 and under will also need the signature of the Judge on a waiver by court order.
- A minor who is pregnant does not need parental consent as long as the pregnancy is verified in a written statement by a licensed physician.
- For all ages under 18 there is a 3 day waiting period.
- You do not have to be a resident of West Virginia to obtain a Marriage License in WV.
- Residents and Non-residents may apply in any county and get married in any county of West Virginia.
- The Marriage License can only be used in the state of West Virginia & is valid for only 60 days.
- You will need to present either a photo Id, such as a driver’s license, state ID, passport or a certified copy of your birth certificate for proof of age. This ID is ONLY for proof of age.
- Both parties must be present when applying for a Marriage License.
- Both parties will need to give their full Social Security number (or Passport/Green card if not a US citizen).
- Both parties will need to give their full legal names (no nicknames or initials), the city and state of birth, their parents full legal names (no nicknames or initials), the parents’ city and state of birth, the mother’s maiden name.
- If previously married, the full date of divorce or if widowed date of spouse’s death must be provided.
- Need to know the correct spelling and dates for all information given.
- The fee for a Marriage License is $57.00. Unless you present a pre-marital letter, when applying, showing that you have received pre-marital counseling, then you will receive a $20.00 discount. (Our office keeps this letter).
- We accept check or cash for payment. Payment is due up front when applying for the Marriage License, unless there is a 3-day waiting period, then the payment is due when picking up the license.
- Certified copies are $5.00 each.
- Fees for the Marriage License and certified copies cannot be combined if writing a check.
- Any ordained minister who has registered with the WV Secretary of State’s office to perform marriages in the State of West Virginia may officiate a wedding.
- Officiates should be registered with the West Virginia Secretary of State in Charleston, WV. www.sos.wv.gov
- It is the Officiates responsibility to return the Marriage License to the County Clerk’s office in the envelope provided.
- As long as all of the information given is correct on day of application, and the license has been paid for, that is the Issue date.
- If there is a 3-day waiting period, and two full days have elapsed from the applicant date, on the day the fee has been collected, that is the issue date.
- When applying-once all the information has been given to the Deputy Clerk, the application will have to be proof read by both parties. Proof read means checking all info…spellings, dates, numbers, etc.
- All mistakes, if any, will have to be corrected before the Marriage License can be given to applicants.
- Once all information has been checked and the application has been signed and payment has been received the Marriage License will be given to the applicants.
- Both parties will be signing under Oath that all the information on the application is correct, so please make sure there are no errors.
- Once the Marriage License has been returned to the Hampshire County Clerk’s office and has been processed, you will receive a Greeting and a form for Certified copies, which you can complete and return to our office, either by mail or in person.
- You may need to present ID when completing this form. Please bring ID just in case.
